What's the difference?

PEO vs. Payroll

Worker's Compensation Coverage
Payroll: We offer workers’ comp alongside our payroll services, though the client could also provide their own.
PEO: Coverage is provided under PEO's master policy or coordinated master policies (some states allow worksite co-employers to carry out client-level WC programs). Under the PEO umbrella, they must use TBM’s workers’ comp.
Risk and Safety Management

Payroll: Client responsibility.

PEO: PEO administers claims management and safety program compliance.

Employer of Record

Payroll: The client is the employer of record.

PEO: A PEO is the federal and most state employer of record. Certain states require client-level reporting, and the PEO has power of attorney to pay.

Human Resources Administration

Payroll: The only human resource responsibilities supported are payroll and making necessary deductions for benefits, insurance, and taxes (where applicable), but the worksite employer is responsible for following proper HR policies and remaining compliant with laws and regulations. 

PEO: Human resource responsibilities are supported by PEO, but the worksite employer is responsible for following proper HR policies compliant with laws and regulations.

Regulatory Compliance

Payroll: Does not manage responsibilities related to regulatory compliance.

PEO: PEO manages responsibilities related to regulatory compliance.

Employee Benefits and Administration

Payroll: Coverage obtained by client.

PEO: Coverage can be offered under PEO master policies, or the client may use their own policy. PEO may also administer the plans.

Payroll Tax Liability

Payroll: The employer is liable.

PEO: The PEO is liable for federal taxes. State rules vary.

State Unemployment Tax (SUTA) Rate

Payroll: The client's SUTA rate is used.

PEO: The PEO's SUTA rate is used (some states require worksite employer-level policies).

Unemployment Claims

Payroll: The client manages unemployment claims.

PEO: PEO manages unemployment claims.
