MA: Payment for Accrued, Unused Sick Time Not Counted as Wages

Massachusetts Supreme Judicial Court Addresses Wage Act

The Massachusetts Supreme Judicial Court has issued an opinion addressing payment for accrued, unused sick time.

Accrued, Unused Sick Time

According to the opinion, payment for accrued, unused sick time does not count as “wages” under the Massachusetts Wage Act (which governs, among other things, payment of wages upon termination).

Employers with questions as to the case’s impact on workplace policies and procedures should contact a knowledgeable employment law attorney.

Background

Unlike accrued, unused sick time, vacation and holiday payments due an employee under an oral or written agreement are considered to be wages under Massachusetts law. Click here for more information.
